1. Acceptance of Terms of Use
By accessing or purchasing via this website (www.ara-shoes.com/en-ca), you agree to these Terms of Use. If you do not agree, please exit and do not use the Website.
We may update these Terms from time to time. We will post an updated effective date at the bottom of this page and, for material changes, provide at least 30 days’ advance notice by email or prominent notice on the Website. Continued use after the effective date constitutes acceptance. If a change materially adversely affects you, you may stop using the Website and, if applicable, cancel an affected service without penalty.
2. Use of the Website
You may use the Website for personal, non-commercial purposes and in compliance with law. You will not misuse the Website (including spamming, distributing malware, or data mining) or interfere with others’ use.

You grant ara Shoes Canada a worldwide, royalty-free licence to use, reproduce, and display user content for Website operation and customer service, subject to our Privacy Policy. We comply with Canada’s private-sector privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and substantially similar provincial laws. We collect, use, and disclose personal information for identified purposes with appropriate consent, limit retention, apply safeguards, and provide access and correction rights. We maintain procedures for reporting breaches of security safeguards as required by law.
We send commercial electronic messages only with express or applicable implied consent under Canada’s Anti-Spam Legislation (CASL). Messages include our identification and a functional unsubscribe mechanism.
6. Suspension or Termination
We may suspend or terminate access for lawful reasons, including security, fraud, or misuse. If we cancel an order, we will provide prompt notice and refund any amounts paid where applicable.
7. Purchasing Products
Products are shipped pursuant to a shipment agreement. Risk of loss transfers upon delivery to the carrier. We provide estimated delivery windows; if delivery is not made within the stated time, please contact customer service for remedies including refund or replacement.
8. Returns
If you are not satisfied with a Website purchase, you may return unused and unworn items within 60 days of shipment with proof of purchase for an exchange or refund of the purchase price, less shipping and handling. For defective items or shipping errors, we refund original shipping. This policy applies only to Website purchases.
Your statutory rights are preserved. In Québec, consumers benefit from legal warranties under the Civil Code of Québec and the Consumer Protection Act; nothing in this policy limits those rights.
9. Pricing Policy & Obvious Errors
We strive for accurate pricing. If an “obvious error” occurs (e.g., $0 or $1 due to a system fault or misplacement of a decimal, or a price that is clearly disproportionate to the product’s known value), we may cancel the order, notify you promptly, and issue a full refund. Where required by applicable law, advertised prices will be honoured once a binding contract is formed.

Links to third-party sites are provided for convenience; we are not responsible for their content or practices. You may link to our Website in compliance with law and our policies; framing is prohibited without written permission.
11. Product Warranty; Disclaimers
ara warrants ara-branded products purchased from the Website against defects in manufacturing and materials for one year from purchase. This does not cover normal wear and tear. Except as required by law and the foregoing limited warranty, the Website and products are provided “as is.”
Nothing in these Terms excludes or limits non-excludable statutory warranties and consumer rights, including those under Québec law.
12. Limitation of Liability
To the extent permitted by law, ara shall not be liable for indirect, consequential, incidental, or punitive damages. Our aggregate liability to you is limited to the amount paid for the product or service giving rise to the claim. This limitation does not apply to liability for bodily injury, fraud, or gross negligence, or where prohibited by applicable law.
13. Indemnification
To the extent permitted by law, you agree to indemnify ara against third-party claims arising from your unlawful misuse of the Website. This indemnity does not apply to ordinary consumer use.
14. Governing Law; Jurisdiction; Dispute Resolution
For customers resident in Québec, these Terms and any dispute are governed by the laws of Québec and the laws of Canada applicable in Québec. Courts of Québec at the consumer’s domicile have exclusive jurisdiction, and nothing limits the consumer’s rights under the Consumer Protection Act (Québec).
For customers resident elsewhere in Canada, these Terms are governed by the laws of the consumer’s province or territory and the laws of Canada applicable therein. Mandatory arbitration clauses do not apply; consumers may elect voluntary arbitration after a dispute arises.
15. Remedies for Breach
We may warn, suspend, or terminate access for violations of these Terms and cooperate with law enforcement where required.
